General terms and conditions of sale CHUBERB 2025 ( Bonne Maison)

Our representatives are responsible for processing sales on our behalf, but sales only become final once they have been accepted by us.

Invoice prices are those in force on the day of delivery and payment terms are calculated from the date of dispatch.

The current price applies to a product delivered individually in a paper bag.
Any change of finish or special request will be subject to a supplement.

Unless the purchaser objects in writing within three days of receipt of this document, we shall be deemed to accept its contents and our general terms and conditions of sale without reservation, even in the event of clauses to the contrary included in the purchaser's own general terms and conditions.

We endeavour to deliver goods within normal lead times, but strikes, epidemics, transport interruptions, difficulties in obtaining raw materials from our production plants, are all cases of force majeure which authorise the suspension or delay of orders. Complaints are only valid within thirty days of receipt of the goods.

In all cases where, after a contradictory examination, a claim for defect or hidden defect is recognised, we shall only be obliged to replace the defective product, to the exclusion of all liability and compensation on any grounds whatsoever.

No returns will be accepted without the prior agreement of our sales department. The maximum period for any return is fifteen days after receipt of the goods.

Any delay in payment of an invoice or bill of exchange shall automatically and without formal notice result in the application of late payment interest calculated on the basis of 1 ½ times the legal interest rate (3-month Euribor), from the due date to the date of actual payment. Non-payment of an invoice or bill of exchange immediately renders due payment of any other sum due, even if not yet due.

The products sold remain our property until full payment has been received from the customer (law no. 80335 of 12/05/1980).

The risks associated with the goods are borne by the customer as soon as they are delivered. The customer undertakes to take out insurance covering the risks of loss, theft or destruction of the said goods.
Any additional steps or services requested by the customer will be invoiced at an additional rate of €50 per hour excluding VAT.
All disputes relating to the performance or interpretation of our terms and conditions of sale shall fall within the exclusive jurisdiction of the Lyon Commercial Court.
